[Situation] In the Queen's Park.
The district or tract of land which retains the privilege of a Sanctuary for debtors Consists of the precincts of Holyrood Palace including The Queen's ParK which was first enclosed by James V. to the extent of about 3 miles The right of Santuary of this place was originally a privilege invested in the Abbey of Holy Rood and extended it appears to all criminals who availed themselves of its privileges untill a fair trial was afforded them, In after times when it became exclusively the residence of the Kings the privlege of a Sanctuary for debtors was established which it has since retained. At present there are 15 persons availing themselves of the privilege, but the average number for a few years past is about twelve Formerly the average number was very considerable, the decrease of which is owing to the late changes in the law relating to Debtors and Creditors. The affairs of the Santuary are managed the same as that of a Burgh of Barony the DuKe of Hamilton being the Superior, Within the district is [a] court house where the Bailie who is appointed by the DuKe of Hamilton holds his court for the trial of civil cases of those within his jurisdiction There are also persons appointed who act as constables. The boundary was perambulated by Captn. [Captain] James R.E. [Royal Engineers] assisted by Lce Corpl. [Lance Corporal] Downing R.S. & M [Royal Sappers & Miners] [continued on page 12]
